WHAT AMOUNTS TO ‘PROCESSING PERSONAL DATA’ UNDER THE GDPR?

Understanding what amounts to ‘processing personal data’ is vital as an organisation cannot be compliant with data protection legislation unless it knows what data it is processing, and how those data are processed.

Under the GDPR, ‘processing’ personal data means much more than using individuals’ personal data actively. It covers the collecting, inserting, storing, amending, analysing, exploiting, transferring, extracting and even erasing of personal data, and applies to databases of all kinds, including those of existing customers, data suppliers, employees, sales contacts and marketing targets. Likewise, it applies to the use of individuals’ biometric data and CCTV footage, as well as pattern-tracking including location and purchasing patterns. It is also worth noting that the regulations are not limited to a particular means of processing – they apply to the processing of paper-based records and information in the same way as they apply to electronic ones.

So, almost every employee of an organisation will find themselves involved in personal data processing at some stage and obligations arising from the GDPR are likely to affect many processes and activities regularly carried out by organisations.
